PUBLIC AGREEMENT (OFFER) REGARDING CHARITABLE DONATIONS

This agreement is an official public offer applicable to individuals visiting https://alexzaiwukelan.org.ua/ who wish to make charitable donations. The offer is presented by the charitable organization "Way to future UA," signed by head Mykyta Zhalnin.

1. DEFINITIONS

Public Offer — official proposal from the Foundation published on the Website requesting unlimited individuals to make charitable donations.

Acceptance — occurs when a Donor makes payment via Website tools or transfers funds to the Foundation's account; acceptance happens upon receipt of funds.

Charitable Donation — voluntary, gratuitous transfer of funds/property by Donor to Foundation supporting its objectives under Ukraine's Law "On Charitable Activities and Charitable Organizations."

Seller — Charitable foundation "Way to future UA" (registration code 44947699), located at: Ukraine, 52005, Dnipropetrovsk region, Dnipro city, Slobozhanske village, St. Heroes of Ukraine, 27c.

2. SUBJECT OF THE AGREEMENT

The agreement stipulates voluntary, gratuitous monetary donations supporting the Foundation's legitimate goals and charitable aid programs per Ukrainian law and the Foundation's statute. Donors independently determine donation amounts with no expectation of economic benefit or commercial transactions.

3. ACCEPTANCE OF THE OFFER

Donors accepting confirm familiarity with the Foundation's statute (available on Website) and agree the Foundation may use donated funds portions for administrative expenses within legally established limits. Per Civil Code Articles 207, 639(2), 641, and 642, charitable donations are concluded upon offer acceptance. Written agreements aren't mandatory for validity.

4. FOUNDATION RIGHTS AND OBLIGATIONS

Rights:

  • Accept and use charitable donations per offer and agreement
  • Change donation direction within legal activities
  • Use donation portions for administrative expenses without additional consent, respecting legal limits

Obligations:

  • Provide conditions enabling charitable donations
  • Use donations per statute requirements
  • Protect Donor personal information; non-disclosure to third parties without consent except legally required

5. DONOR RIGHTS AND OBLIGATIONS

Rights:

  • Make charitable donations to Foundation account per agreement
  • Request Foundation reports regarding donation use

Obligations:

  • Carefully read offer terms and applicable rules before donating

6. PLACE AND TERMS OF COLLECTING CHARITABLE DONATIONS

Per Ukraine's Law "On Charitable Activities and Charitable Organizations" (Article 7), donations can be collected worldwide. Collection occurs on Foundation territory, continuing until Foundation liquidation or new terms establishment.

7. METHODS OF MAKING CHARITABLE DONATIONS

Foundation provides electronic payment options on Website or bank transfer (IBAN UA103052990000026009050580853). Donors choose one-time or regular donations (cancelable anytime). Payments complete upon bank/payment system confirmation. Donors bear related expenses.

8. USE OF CHARITABLE DONATIONS

Foundation uses funds per statutory objectives with independent distribution rights. Donors/representatives may monitor donation use. Donated funds are non-refundable.
